Terms of Service

These Terms of Service (“Terms”) govern your use of the FlashTotes website and rental services provided by PopNet Media LLC (“FlashTotes,” “we,” “us,” or “our”). By placing an order or using our services, you agree to be bound by these Terms. Please read them carefully.

1. Service Description

FlashTotes provides reusable plastic moving tote rentals with free delivery and pickup. We deliver clean, sanitized totes to your specified address at your chosen delivery date, and pick them up after your rental period ends. Our service is available in select cities and metropolitan areas across the United States.

Service availability is subject to change. We reserve the right to expand or restrict our service area at any time. Check our Locations page for current availability.

2. Rental Terms

Rental Period

Rental periods are available in 1-week increments, with a maximum rental period of 4 weeks per order. Your rental period begins on your scheduled delivery date and ends on your scheduled pickup date.

Extensions

If you need to extend your rental beyond the original pickup date, you must contact us at least 48 hours before your scheduled pickup. Extensions are subject to availability and may incur additional charges at the prevailing weekly rate.

Tote Quantities

You agree to return the same number of totes that were delivered to you. Missing totes will be charged at the replacement cost per tote, as listed on our pricing page at the time of your order.

3. Payment

All payments are processed securely through Stripe. By providing payment information, you authorize us to charge your payment method for the total amount due, including any applicable fees. All prices are listed in US dollars.

Payment is collected at the time of order. You will receive a receipt via email confirming the charge. We do not store your full payment card information on our servers.

Any additional charges (e.g., for missing totes, excessive cleaning, or rental extensions) will be charged to the payment method on file. We will notify you before applying any additional charges.

4. Delivery and Pickup Policy

Delivery

Delivery is free within our service area. We will deliver totes to the address you provide during checkout. Someone 18 years or older must be present or available to receive the delivery unless we agree otherwise in writing. We will make reasonable efforts to deliver on the scheduled date; however, delivery times may be affected by weather, traffic, or other circumstances beyond our control.

Pickup

Pickup is free and scheduled for your selected pickup date. Totes must be stacked and accessible at the delivery address or another agreed-upon location. If we are unable to complete pickup due to access issues, a rescheduling fee may apply.

Missed Delivery or Pickup

If you need to reschedule a delivery or pickup, please contact us at least 24 hours in advance. Missed appointments without advance notice may result in a rescheduling fee.

5. Tote Care and Condition

Our totes are designed to be durable and reusable. You agree to:

  • Use totes only for their intended purpose of moving and storing household or business items
  • Not use totes to transport hazardous materials, chemicals, liquids, or anything illegal
  • Return totes in the same general condition as received (normal use is expected and accepted)
  • Not stack totes beyond their recommended weight capacity
  • Not permanently mark, paint, or alter the totes

You are responsible for any damage beyond normal wear and tear. Damaged totes will be assessed at the time of pickup, and repair or replacement costs will be communicated to you within 48 hours.

6. Money-Back Guarantee

We stand behind our service with a 100% money-back guarantee. If you are unsatisfied with your FlashTotes experience for any reason, contact us at hello@flashtotes.com within 7 days of your pickup date, and we will issue a full refund of your rental fee.

This guarantee does not apply to charges for missing or damaged totes, or fees resulting from your failure to be available for a scheduled delivery or pickup.

7. Cancellation Policy

  • Cancellations made 48 hours or more before your scheduled delivery: Full refund, no questions asked.
  • Cancellations made less than 48 hours before your scheduled delivery: A cancellation fee equal to 50% of the rental cost will apply. The remaining balance will be refunded.
  • After delivery has occurred: No refund on the rental fee (money-back guarantee terms apply; see Section 6).

8. Limitation of Liability

To the fullest extent permitted by applicable law, FlashTotes and PopNet Media LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services, including but not limited to loss of property, loss of data, or personal injury.

Our total liability for any claim arising from these Terms or your use of our services shall not exceed the total amount you paid us for the rental in question.

We are not responsible for damage to items placed inside the totes, including breakage resulting from improper packing. We recommend proper packing techniques and the use of appropriate padding materials.

9. Indemnification

You agree to indemnify, defend, and hold harmless FlashTotes and PopNet Media LLC, and their officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of our services or your violation of these Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Alabama, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Madison County, Alabama.

11. Changes to These Terms

We reserve the right to update these Terms at any time. When we make changes, we will update the “Last updated” date at the top of this page. Your continued use of our services after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
